Affidavit of Restitution
When a court orders an affidavit of restitution the system demands that the defendant in the particular case give up a financial gain to the individual claiming restitution. In these situations, the claimant must have a legitimate reason to seek restitution for the monetary loss they suffered.
To initiate such a legal action the claimant must file an affidavit of restitution with the court system, which will review the documentation and administer the repayment of loss if there is a legitimate reason to do so.
